Terms of Use (EULA)

1. License Grant

Subject to your compliance with this EULA, NeuralNest Solutions Pvt Ltd grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the OneCareSync application on a device that you own or control, solely for your personal, non-commercial use.

1.1 Restrictions

You may NOT:

• Copy, modify, or distribute the App or any portion thereof
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Rent, lease, lend, sell, sublicense, or transfer the App to any third party
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any unlawful, harmful, or unauthorized purpose

1.2 Ownership

The App and all intellectual property rights therein remain the sole property of NeuralNest Solutions Pvt Ltd. This EULA does not grant you any ownership interest in the App, only a limited right of use as set forth herein.

2.3 Billing and Auto-Renewal

3. Subscription Management

3.1 How to Cancel

You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. To cancel:

Uninstalling the App does NOT cancel your subscription. You must cancel through your device's store settings as described above.

3.2 Restore Purchases

If you reinstall the App or switch devices, you can restore your active subscription by logging into your account. The App will automatically detect your active subscription from the Apple App Store or Google Play Store.

4. Free Trial (If Offered)

We may offer a free trial period for Premium Membership. If offered:

• Free trials are limited to one per user, per Apple ID or Google account
• You must cancel before the free trial ends to avoid being charged
• If you do not cancel, the subscription will automatically begin at the end of the trial period and you will be charged the subscription price
• Any unused portion of a free trial is forfeited when purchasing a subscription

5. Apple Licensed Application End User License Agreement

If you downloaded OneCareSync from the Apple App Store, you acknowledge and agree that:

• This EULA is between you and NeuralNest Solutions Pvt Ltd only, and not with Apple Inc. ("Apple")
• NeuralNest Solutions Pvt Ltd, not Apple, is solely responsible for the App and its content
• Apple has no obligation to furnish any maintenance and support services with respect to the App
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation
• NeuralNest Solutions Pvt Ltd, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App
• In the event of any third-party claim that the App infringes a third party's intellectual property rights, NeuralNest Solutions Pvt Ltd, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim
• Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary

This EULA incorporates by reference Apple's Licensed Application End User License Agreement. In the event of a conflict between this EULA and Apple's standard EULA, this EULA shall prevail.

7. AI-Powered Features and Third-Party Data Processing

7.1 AI Features

OneCareSync includes optional AI-powered features (Health Summary, Template Assistant, Quick Task, and Task Suggestions) that use artificial intelligence to generate health insights and care task recommendations. These features are available only to users who provide explicit consent.

7.2 Third-Party AI Processing

AI features are powered by Google LLC through their Gemini AI API. When you use an AI feature, anonymized health data is transmitted to Google's servers for processing. Personal identifiers (names, emails, profile IDs, real medication names, doctor names) are removed before any data is sent. For full details on what data is and is not shared, please refer to Section 2.4 of our Privacy Policy.

7.3 Consent and Opt-Out

You must review and accept the AI data sharing disclosure before using any AI feature. If you decline, the AI features will be unavailable but all other app functionality will continue to work. You may revoke consent at any time through account settings.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEURALEST SOLUTIONS PVT LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS LESS.

10. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and destroy all copies in your possession.

We may also terminate or suspend your access to the App at any time, with or without cause, with or without notice.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal proceedings shall be brought exclusively in the courts located in Bangalore, Karnataka, India.

12. Changes to This EULA

We reserve the right to modify this EULA at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, through in-app notifications. Your continued use of the App after any changes constitutes your acceptance of the revised EULA.
